PolitiFact: Sunrise mayor?s statement about Baker Act half-true

Following the shooting at the Sandy Hook elementary school in Newtown, Conn., Sunrise Mayor Mike Ryan has become one of the leading advocates in Broward County for changing laws to improve school safety.

Ryan called for several gun control measures, including the need to address mental health and guns, in the political blog browardbeat.com.

?Now someone committed involuntarily for 72 hours under the ?Baker Act? (as a danger to themselves or others) will have their guns returned to them by the police automatically and immediately upon discharge after 72 hours AND their commitment is never entered into a background check database,? said Ryan. ?As a result, there is also no impediment or second thought given to someone being released and purchasing a gun.?

Ryan?s claim, made in a guest column for the blog on Jan. 14, suggests that it?s a cinch for someone ?committed? under the Baker Act to reclaim their guns and then stay off lists that would ban them from getting a new one. We decided to check it out.

Under the Baker Act, law enforcement can take someone against his or her will to a facility for a mental health evaluation if the person is a danger to themselves or others. A person can?t be held involuntarily for longer than 72 hours, but a medical expert needs to examine the person and sign off on his or her release.

The simple act of being held under the Baker Act doesn?t mean the person is mentally ill or in need of commitment. In 2010, less than 1 percent of about 140,000 involuntary examinations led to involuntary placement in a mental health treatment facility, according to the Florida Department of Children and Families. (That number doesn?t account for people who voluntarily remained in facilities.)

We couldn?t find data regarding how often someone who is Baker Acted has a firearm taken.

?Most individuals don?t have weapons at the time of the Baker Act,? said Miami-Dade County Judge Steve Leifman, who chairs judicial committees on mental health.

But interviews with attorneys, law enforcement officers and experts on the Baker Act revealed that it does happen.

Whether the law enforcement agency takes the gun for safekeeping depends on the specific case, they said.

For example, if a wife reports that her husband is despondent and has a gun and he is Baker Acted at home, police would take the gun, said Col. Jim Previtera of the Hillsborough County Sheriff?s Office. But if someone is Baker Acted on the street and didn?t have a gun with him, the sheriff?s office wouldn?t go to the home and seize the gun.

For evidence of Ryan?s claim, he pointed us to a 2009 Florida attorney general?s opinion. It specifically states that law-abiding people who are released under the Baker Act should get their guns back.

?In the absence of an arrest and criminal charge against the person sent for evaluation under Florida?s Baker Act, [law enforcement] may not retain firearms confiscated from such persons and retained by that office,? concluded then Attorney General Bill McCollum.

The opinion didn?t outline procedures for gun retrieval. So in practice, that means ?there is absolutely no consistency around the state in how this is being practiced,? said former state Baker Act director Martha Lenderman, who now trains law enforcement.

Furious mums turned out in the force outside Channel 7?s studios in Martin Place, juggling bubs on their chests. As is their right.

But while this was happening, there was another protest underway.

You just wouldn?t have heard a whole lot about this one. That?s because there was no rally. No public outcry. No TV cameras.

It?s a demonstration that many women participate in everyday. The only difference being that it is a silent and solitary protest.

Their protest is less a demonstration than a plea: Stop hurting me.

An astonishingly high number of Aussie women will be assaulted or sexually abused in their lifetimes. One in three, figures furnished by the White Ribbon Foundation say.

This violence stems from the sexism of whole communities.

Of blokes who say ?she deserved? it over sinking a few schooners; even of some deeply conservative religious groups that refuse to approve of women divorcing their husbands if they beat them, or force women to marry people they do not love.

The victims of this violence are wives, mothers, sisters, daughters. Even Jill Meagher was one of them.

Every disaster, like Jill?s, hurts. We all felt for Jill. My heart broke then, last year, when my girlfriend said after the killing: ?Great, I?m just going to end up in a bag somewhere.?

One violence expert I talked to yesterday compared Australia?s reaction to violence against women with the recent spate of mass shootings in the United States.

?Every time, people talk about there being tipping points, or that community reaction feels different this time ? or maybe they?re just desperately hopeful this time?s going to be different,? said Greg Aldridge, the co-director of the Canberra Men?s Centre.

The violence keeps happening though. For instance, the number of domestic violence deaths in WA more than doubled last year.

David Koch said something that I reckon wasn?t overly well thought out.

But he?s just a guy. As a guy who is known to say dumb things in conversation with friends all the time, I can sympathise.

Now that the dust on the breastfeeding debate has settled, what we should really all be getting angry about isn?t some media storm in a teacup.

From gulags to dusty donkeys, Google Maps reveals Earth's mysteries

On Monday, Google officially updated North Korea on Google Maps. Thanks to crowd-sourced data, the area is no longer blank, but instead includes markings for just about everything???right down to the locations of its prison camps. This isn't the first time Google Maps (and its 3-D counterpart, Google Earth) helped reveal previously obscured ??or even unknown ??geography.

In late 2011, Google Maps images called attention to strange patterns etched into the surface of China's Gobi Desert. There were speculations that the patterns were related to weapons-testing sites or even messages from aliens,?but?the?consensus,?according?to?Natalie Wolchover?of?Life's?Little?Mysteries,?was?that?they?were?satellite?calibration?patterns.?

Another pattern found not far from there, a?"Stonehenge-like arrangement of objects radiating outward, with fighter jets parked at its center,"?is?likely?used to test radar from space.

A year later, yet another mysterious pattern was spotted in yet another Chinese desert.?LiveScience's?Tia Ghose?reported?that?these?were?the?result?of?geological surveys for nickel mines.

Google Earth, another aspect of Google's geo project,?has also?helped an?archaeologist discover ancient Egyptian ruins. Much of the excitement over that discovery evaporated though as?? after?some initial?confusion regarding whether they ruins?were previously undiscovered pyramids or other formations???it?turned?out?that at least?some other?researchers?were?already?aware?of?this?point?of?interest.

Thanks to Google Maps' Street View, folks have been exploring areas they may never see in person. For example, thousands of images from Australia's Great Barrier Reef and other coral locales were stitched together into 360-degree panoramas, so that anyone can take a trip from the comfort of his or her own desk.

"This will allow the 99.9 percent of the population who have never been diving to go on a virtual?dive for the first time," said Richard Vevers, project director for the Catlin Seaview Survey (which worked in partnership with Google to capture images for these panoramas),?told NBC News when the project was first publicized.

Ancient Mexican monuments such as Teotihuacan, Chichen Itza and Palenque are also included in virtual tours, along with?countless businesses which, as part of an extension to the Google Street View project, allow users to virtually explore building interiors.

Sometimes Google's mapping products can cause controversy. When?a data glitch related to Google Earth's underwater seafloor imagery led to the appearance of a grid-like pattern, some proclaimed it?must indicate the existence of Atlantis. The "evidence" of the mythical city's presence disappeared as soon as Google incorporated fresh data and smoothed over imaging artifacts.

At least one mapping controversy ended with new research, however.?When a Nicaraguan general?alleged that Google Maps displayed erroneous borders between his country and Costa Rica. The secretary general of the Organization of American States was sent in to examine the area and resolve the cartographic drama.

And then there was that time a?Google Street View car ran over a donkey ? or at least appeared to. ?"Over the last 24-hours concerned members of the public and the media have been speculating on the fate of a donkey pictured in Street View in the Kweneng region of Botswana,"?wrote?Google's?Kei?Kawai?in?a?blog?post.?Fortunately?for?Google,?the?car?took?many?photos,?and?a?review?of?them?clearly?showed?the?donkey?moving?aside?safely.?"I'm pleased to confirm the donkey is alive and well."

Google's not above showing us what's behind the curtain in its own data centers, either. Thanks to Street View tours of the interiors of the company's previously unseen buildings, we now know that Stormtroopers and R2 units guard our precious data.

For Diabetes: BP, Cholesterol Key v. Heart Disease

Jan. 28, 2013 -- People with diabetes who want to lower their risk of heart attack and stroke should focus on controlling their blood pressure and ''bad'' cholesterol, according to a new study of more than 26,000 patients.

Controlling both these risk factors, the researchers found, made patients less likely to be hospitalized for heart attacks or strokes than those who only controlled blood sugar during the six-year follow-up.

"It's not that blood glucose is not important. It's that low-density cholesterol and blood pressure control are more important if cardiovascular disease is what you are trying to prevent," says Gregory A. Nichols, PhD, a senior investigator at Kaiser Permanente Center for Health Research.

The study is published in the Journal of General Internal Medicine.

Diabetes & Heart Disease: Study Details

More than 18 million people in the U.S. have diabetes, according to the American Diabetes Association.?

Those with type 2 diabetes (in which the body doesn't make enough insulin or use it properly) have a higher risk of heart disease and stroke.

To minimize the risk, research suggests, those with diabetes should control not only blood sugar levels but also their LDL or ''bad" cholesterol and their blood pressure.

However, Nichols says, he is not aware of any study that looked at the contribution of these risk factors to heart attack or stroke risk among people with diabetes.

For the new study, the researchers calculated all patients' average values on systolic blood pressure (the upper number of the reading), cholesterol, and blood sugar levels.

"There were actually eight different possible categories," Nichols says. These ranged from having none of the risk factors under control to having all of them under control.

Guidelines suggest that systolic blood pressure in those with type 2 diabetes should be less than 130.

"LDL ideally is less than 100 [mg/dL] and A1c [a blood sugar measure] is less than 7%," Nichols says.

Next, they looked at whether the patients had a hospital admission with a diagnosis of heart disease or stroke. During the study, 1,943 patients were hospitalized for those reasons.

Those who were in the hospital were on average 65 years old. Those who were not were on average 58.

Nichols looked at the risk factor status of all patients.

At just over 7 billion in number, human beings are kind of a big deal. Despite our greatness in numbers, however, there are quite a few other species sharing our little blue dot. Sadly, the one greatest in number isn't something you see every day or ... well, ever, for that matter. And say what you will about obesity in our society, but PBS' "Life By the Numbers" Digital Short (part of its new "It's Okay to be Smart" series) argues that human biomass (287 million tons) is nowhere near that of even a single species of krill (500 million tons). Take that, Richard Simmons!
